Subject: ODG: Proprietary estoppel in the HL

Dear Colleagues:

Those of you interested in proprietary estoppel will be interested in the House of Lords decision in Thorner (Appellant) v Majors and others (Respondents) [2009] UKHL 18 (http://www.publications.parliament.uk/pa/ld200809/ldjudgmt/jd090325/thorn-1.htm). 

Personally, I think that their Lordships have taken a wrong turn and are taking the concepts of property and estoppel too seriously and are treating these cases as if they are another, albeit informal way to transfer property. But I am sure others will disagree.
